1.1 These Terms and Conditions of Sale are for the online sale of Products through e-commerce service on the http://www.pierocalzature.it/ (hereinafter Website).
1.2 The Products sold on the Website can be purchased and delivered to the countries specified in the Order Form. Any orders for shipments to be made outside of these countries will be automatically rejected during the order process.
2.1 The Products are sold directly by Piero Calzature Ltd. di Grementieri Alfiero Son as ______ with registered office in Italy, in Via delle Lame, 56, 40122 Bologna, registration number with the Italian Registro delle Imprese BO - XXXXX, VAT XXXXXXXXX (henceforth Piero Calzature di Grementieri Alfiero & Son or Seller). 2.2 These Terms and Conditions of Sale determine the offer, transmission and acceptance of purchase orders relating to Products on the Website and do not cover the supply of Services or sale of Products by parties other than the Seller which are present on the Website through links, banners or other hypertext links. Before confirming orders and purchasing Products and Services from parties other than the Seller, we suggest to check their terms and conditions of sale because the Seller is not responsible for the provision of Services by third parties.
2.3 The Products are sold to the Customer who is identified by the data entered at the time of filling in and submission of the order form in electronic format with the simultaneous acceptance of these Terms and Conditions of Sale.
2.4 The offers of Products on the Website are addressed to Customers of at least 18 years of age. If the Customer is under 18, the consent of a parent or legal guardian will be necessary in order to make the purchase. Making an order through this Website, guarantees that you are of legal age (over 18 years old) and have the legal capacity to enter into binding contracts.
2.5 The Customer is not allowed to enter false and/or invented and/or made up names in the order process online and in subsequent communications. The Seller reserves the right to prosecute any violation or abuse, in the interest of and to protect all Consumers.
2.6 By agreeing to these Terms and Conditions of Sale, the Customer also exempts the Seller from any liability arising from incorrect tax records due to errors in the data supplied by the Customer in the online order. The Customer is solely responsible for filling in the online forms.
3.1 E-commerce sale refers to a contract made at a distance with the aim being the sale of movable goods (hereinafter Products) agreed upon between the Customer and Piero Calzature Grementieri di Alfiero & Son, as a Seller, as part of e-commerce service by the Seller that, for this purpose, used communication technology at a distance called the Internet.
3.2 To make the purchase of one or more Products, the Customer must fill out the order form in electronic format (from now on Order) and post it to the Seller through the Internet by following the instructions.
3.3 The Order contains:
- A reference to the Terms and Conditions of Sale, containing the procedures and deadlines for the return of Products purchased and the right of withdrawal conditions for the Customer;
- Information and / or images of each Product and its price;
- The means of payment that the Customer can use;
- The arrangements for delivery of Products purchased and the costs of shipping and delivery;
3.4 Although Piero Calzature di Grementieri Alfiero & Son constantly adopt measures to ensure that the photographs displayed on the Website are faithful reproductions of the original Products, using every technological solution possible to minimize inaccuracies, some variations are always possible because of technical characteristics and the color resolution characteristics which depends on the Customer's computer's characteristics. Consequently, the Seller shall not be responsible for any inadequacy of graphic representations of the Products shown on the Website owing to the above technical reasons, as these representations are merely for illustrative purposes.
3.5 Before concluding the contract, the Customer will be asked to confirm that the Terms and Conditions of Sale have been read including the Information on the right of withdrawal and the processing of personal data.
3.6 The contract is concluded when the Seller receives the Customer's order form by internet, after verification of the data relating to the order.
3.7 The language available for concluding the contract with the Seller is the one chosen by the Customer, in any case, the applicable law is the Italian one.
3.8 After the contract, the Seller will handle the Customer's Order.
4.1 By posting off the Order on the Internet, the Customer unconditionally accepts the relationship with the Seller, and these Terms and Conditions of Sale.
4.2 After the contract, the Seller will post the Customer, an email confirmation of the order, containing a summary of the information contained in the Order described in sections 3.3, 3.4 and 3.5.
4.3 The Seller retains the possibility to request further information regarding the Order before posting the Order Confirmation, by e-mail or on the phone according to the details indicated by the Customer.
4.4 The Seller may not process purchase orders if the Customer does not give sufficient payment guarantees or if details are incomplete or incorrect, or in the event of the unavailability of Products. In these cases, the Seller will inform the Customer by e-mail that the contract has not been executed and that the Seller has not accepted the Order of the Customer specifying the reasons. In this case the Customer's previously engaged payment will be disengaged.
4.5 If the Products displayed on the Website are no longer available for sale after the posting of the order, the Seller will notify the Customer about the unavailability of Products ordered promptly and in any case within thirty (30) working days from the day after the one in which the order has been be forwarded to the Seller. In this case the sum previously charged on the method of payment section will be refunded to the Customer.
4.6 Each sale made by the Seller through the online sales service can cover one or more Products, with no limit on quantity for each item.
4.7 The Seller reserves the right to refuse orders from a Customer if there is an ongoing legal dispute regarding a prior order. This applies equally to all cases in which the Seller considers the Customer unsuitable, including, for example, the case of previous violations of the conditions of contract for purchase online on the Website or for any other legitimate motivation, especially if the Customer has been involved in fraudulent activity of any kind.
5.1 Unless otherwise stated in writing, all prices of the Products and the shipping costs and delivery times indicated on the Website and in the Order include VAT and are given in Euros. The valid price is always and only the one indicated on the Website at the time of the Order transmission by internet. Product prices and shipping costs and delivery times may vary without notice. The Customer must therefore determine the final price of sale before posting off the relevant Order form.
5.2 All Products are shipped directly from Italy. Product prices and shipping costs and delivery times indicated on the Website and in the Order, unless otherwise stated, do not include any costs related to customs duties and taxes for shipping outside the EU or in countries where the legislation imposes import charges.
5.3 These costs are charged to the Customer and are to be paid directly upon delivery of the Products, according to the instructions specified in the Order Confirmation.
One of the procedures summarized below and indicated on the Order form on the Website, can be used to pay the price of the Products and the shipping and delivery costs.
6.1 Payment by credit cards and prepaid cards.
6.1.1 For orders on the Website, the Seller accepts payments by credit card and prepaid cards (if enabled by the bank or by PayPal) without any added cost to the cost of the Product and shipping. It is understood that the Customer must be the holder of the valid credit card for the order of Products purchased online and that the name written on the credit card must be the same as the one on the billing information. Otherwise, it will not be possible to proceed with the order.
6.1.2 When buying online, together with the confirmation of the order, we will charge the amount of the Order on the Customer's credit card. The amount will therefore be effectively charged to the Customer's credit card as soon as the Order is sent to the Seller.
6.1.3 If, once received the parcel containing the ordered Products, for any reason the Customer wants to withdraw, the Seller will return the amount paid to the same credit card previously used for payment by the Customer.
6.2.1 If the Customer has a PayPal account, the Seller allows payments to be made using the same email and password the Customer has registered on their account on www.paypal.com.
6.3 The Seller will never be able to know information about the credit card (for example, the credit card number or expiry date), as these are sent by encrypted protocol, via secure connection, directly to the Website that manages the electronic payment (bank or PayPal). No archive of the Seller will retain such information.
6.4 In no event can the Seller therefore be held responsible for any 'fraudulent use of credit cards and pre-paid cards by third parties.
7.1 Each shipment contains:
- The Product(s) or ordered item (s);
- The relevant transport document / invoice;
- Any accompanying documentation required depending on the country of delivery
- Possible information and marketing material.
7.2 The delivery of the Products purchased through the Seller's Website can take place in different ways.
7.3 Delivery to the Customer.
7.3.1 Products purchased will be delivered by the Courier chosen by the Seller to the shipping address provided by the Customer on the Order form. For additional information on costs, timing and methods of delivery and countries served, go to the Shipping section.
7.3.2 Upon receipt of the goods to your home, the Customer is required to verify the integrity of packages upon delivery by the Courier. In case of anomalies, the Customer must make written record from the same Courier and reject the delivery. Otherwise the opportunity to assert their rights in this regard will be lost.
7.4 Delivery to agreed stores and pick up by the Customer.
7.4.1 Only in case this option is specifically provided, the Products purchased will be delivered by the Seller to the Customer at an agreed store that the Customer can select when placing the Order. Refer to the Shipment section for additional information on costs, timing and method of delivery and countries served.
7.4.2 Upon delivery of Products purchased, the Customer will receive a message via SMS and / or email and by that time will have up to 10 days of time to collect the Products of the Order as described in the Order Confirmation.
7.4.3 Failure to collect Products at the end of this period will result in the cancellation of the order by the Seller and a refund of the full amount previously paid, net of transport costs. Repayment will be made to the Customer's credit card or PayPal account depending on the method of payment chosen when purchasing online.
8.1 Only if the Customer accepting the contract is a Consumer (meaning by this definition any person who is on the Website for purposes unrelated to business or professional activity), will they have the right to withdraw from the contract with the Seller, without penalty and without giving any reason, within fourteen (14) working days from the day the goods purchased on the Website are received.
8.2 To exercise the right of withdrawal, the Customer must post an email within fourteen (14) working days from the date the Products are received to the following address: Via delle Lame, 56, 40122 Bologna specifying the Order number and Item code of the Product(s) they want to return.
8.3 After receiving the email previously mentioned, the Customer will receive all the instructions for returning the Product (s).
8.4 The right of withdrawal is subject to the following conditions:
- The returned Products must be returned in their entirety and not only parts or components of them even in the case of kits;
- The returned Products must not have been used, worn, washed or damaged;
- The returned Products must be returned in their original packaging without damaged;
- Products must be returned to the Seller in a single shipment. The Seller reserves the right not to accept Products of the same order returned and delivered at different times;
- Products must be delivered to the Courier within fourteen (14) working days from the date they were received;
- If the Seller allows the Customer to return Products which were bought at a lower price thanks to a package deal (e.g. 5X4, 3x2, etc.), it will be possible to return single items from the package. In this case, the price will be recalculated by referring to the normal whole price of the single item. In all other cases (e.g. bundling options, prizes etc.), the right of withdrawal may be exercised only with the return of all the Products purchased, thus ruling out any partial exclusion.
8.5 If the withdrawal right is exercised by the Customer in accordance with the above conditions (section 8.4), the Seller shall refund the amount paid by the Customer no later than 30 days after the Seller has received the returned Products. Normally the charge back of the amount by the Seller happens very quickly, but the timing in which the crediting will actually be visible to the Customer will depend on their bank, credit card company or PayPal
8.6 When returning, the shipping costs charged to the customer.
8.7 The Seller accepts to pay for the costs of the initial shipment of Products only in case of damage to the same due to transport or incorrect shipment by the Seller. Only in such cases, the Seller will have to reimburse the amount the Customer has paid for shipping. The Seller will post a Courier to pick up the Product at the address indicated by the Customer.
8.8 To make a return, the Customer will have to only use the Courier indicated by the Seller in the return instructions: in this way the Customer will not have to personally pay to return the Products purchased because the Seller will pay directly. Subsequently the Seller, unless as stated in paragraph 8.7 and for returns due to Product defect, will withhold an amount equivalent to the shipping cost and home delivery (differs according to Country) when reimbursing the Customer. This way, once the Products are given to the shipping agent specified in the Online Return Form, the Seller releases the Customer from any liability in case of loss or damage to the Products during transport.
8.9 In case the option of delivering Products to one of the points of sale has been made available at the time of filling in the return form online, the Customer may return the Products directly at the point of sale agreement of the Seller. In this case the Customer will be refunded only the price paid for the purchase, also shipping costs previously incurred for the delivery of Products purchased. Since the return of Products at point of sale, the Seller dismisses the Customer from any liability for any loss or damage during transport.
8.10 In the event of exercising the right of withdrawal, the Seller will refund the corresponding amount within 30 days from the date the Products are received according to the instructions described above, by crediting the amount to be refunded with the same payment method chosen by the Customer at the time of order.
8.11 In the case of exercising the right of withdrawal without complying with the procedures described above (e.g. taking more than the 14 days agreed to by law, or not following the return instructions), the Seller will post the purchased Products to the Customer charging them the additional shipping charges.
8.12 The right of withdrawal can not be applied to Products which have been customized on the Customer's request at the time of order.
9.1 The Seller is responsible for any defects in the Products offered on the Website, including items which do not match the Products ordered, in agreement with the Italian law.
9.2 If the Customer has signed the contract as a Consumer (meaning by this definition any person who is on the Website for purposes unrelated to business or professional activity), this guarantee is valid provided that both conditions mentioned below are met :
a) the defect appears within 24 months from the Product date of delivery;
b) the Customer formally claims the defects within a maximum of two months from the date when the defect was recognized by the latter;
c) the return process is correctly followed.
9.3 In particular, in the case of non-standardization, the Customer that signed the contract as a Consumer will be entitled, if the Seller agrees, to a correction of the conformity of Products free of charge, by repair or replacement, or to an appropriate reduction of the price by dissolution of the contract with regard to those goods, and the consequent refund of the price.
9.4 All returning costs for defective Products will be paid for by the Seller.

The Customer acknowledges, accepts and gives consent that all notices, notifications, certificates, information, account statements and any documentation on the transactions carried out, referring to the purchase of Products. All this information will be sent to the Customer's email address (provided during registration) in order to give the possibility to download the information permanently in accordance with the Website.
13.1 These Terms and Conditions of Sale are governed by the Italian law and will be interpreted according to it, except in case of any overriding mandatory rule of the country of residence of the Customer. Consequently, the interpretation, performance and resolution of the Terms and Conditions of Sale are governed exclusively by the Italian law and any related and/or consequent controversies shall be resolved exclusively by the Italian courts. In particular, if the Customer considered as a Consumer, has any controversies they will be resolved by the court of the place of domicile or residence of the same according to the applicable law or, at Customer's choice in case of legal action started by the Customer, by the Reggio Emilia Court. If the Customer is a business, of commercial, craft or professional type, the parties will consensually establish the exclusive jurisdiction of the Court of Reggio Emilia.
The Seller may modify or amend these Terms and Conditions of Sale at any time. Therefore, the Customer will be required to accept only the Terms and Conditions of Sale in force at the time of purchase. The new Terms and Conditions of Sale shall be effective from the date of publication on the Website and in relation to purchase orders submitted after that date.
